Policies

In All pricing is in Canadian dollars.

Shipping Policy – Orders are processed within 48 hours after payment has been received. We normally ship via Canada Post within 1-3 business days after receiving your order payment, unless there is an unexpected delay.

Pickup orders are not available at this time

Return policy – No returns will be accepted on products due to the personal use of items.

The use of the website www.jaskdesin.ca is governed by the following terms and conditions set out below and in other stated policies on the website. It is important that you note by using this website and/or submitting an order, you indicate your acceptance of and agreement to be bound by the following terms and conditions. Jaskdesign reserves the right to amend these terms and conditions at any stage in the future.

Shopping

In the purchasing of any items from the website, you will be asked to provide personal information, including but not limited to your name, address, email, and telephone number. You agree that all information provided, will be accurate, complete and up to date. Additionally you will be responsible for paying any taxes where applicable, and all associated shipping charges for your purchase. Jaskdesign retains title to all items purchased until payment is received, at which time the title passes to the purchaser.

Taxes

All purchases within Canada accrue a Goods and Services Tax (GST), of currently 5% (except for nursing pads which is 12%). In deliveries to Nova Scotia, Newfoundland & Labrador and New Brunswick, the Harmonized Sales (HST) of 13% is currently applicable. Please note the taxes are applicable based on the address delivery.

Miscellaneous

If any provision of these terms & conditions be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. These terms and conditions in combination with the other stated policies on the website constitutes the entire agreement between the parties relating to the subject matter herein.

Governing Law

Transactions between Jaskdesign and the customer will be governed and construed in accordance with the laws of the Province of British Columbia, without regard to the laws regarding conflict of law. Any litigation regarding this agreement or any transaction between Jaskdesign and the customer shall be brought in the provincial or federal courts located in Vancouver, British Columbia, Canada and the customer hereby agrees and submits to such jurisdiction.

What personal data we collect and why we collect it

In this section you should note what personal data you collect from users and site visitors. This may include personal data, such as name, email address, personal account preferences; transactional data, such as purchase information; and technical data, such as information about cookies.

Only personal data collected is from user email requests, comments and reviews which the user generates giving a user name and email address, and a generated iP address. Collected to verify user reviews or to return contact for services. By filling out any forms on website you are giving consent to be contacted or review to be published. Shopping Information -name address is collected to deliver products for mailing only not for advertising. Further explanation below in Woo Commerce section

No collection or retention of sensitive personal data, such as data concerning health.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: httpss://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Contact forms

By default, WordPress does not include a contact form. If you use a contact form plugin, use this subsection to note what personal data is captured when someone submits a contact form, and how long you keep it. For example, you may note that you keep contact form submissions for a certain period for customer service purposes, but you do not use the information submitted through them for marketing purposes.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

WooCommerce Services

 We collect information about you during the checkout process on our store.
While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints
  • Process payments and prevent fraud
  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes
  • Improve our store offerings

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for XXX years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.
We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.

Data Used: For payments with PayPal or Stripe: purchase total, currency, billing information. For taxes: the value of goods in the cart, value of shipping, destination address. For checkout rates: destination address, purchased product IDs, dimensions, weight, and quantities. For shipping labels: customer’s name, address as well as the dimensions, weight, and quantities of purchased products.

Data Synced (?): For payments, we send the purchase total, currency and customer’s billing information to the respective payment processor. Please see the respective third party’s privacy policy (Stripe’s Privacy Policy and PayPal’s Privacy Policy) for more details. For automated taxes we send the value of goods in the cart, the value of shipping, and the destination address to TaxJar. Please see TaxJar’s Privacy Policy for details about how they handle this information. For checkout rates we send the destination ZIP/postal code and purchased product dimensions, weight and quantities to USPS or Canada Post, depending on the service used. For shipping labels we send the customer’s name, address as well as the dimensions, weight, and quantities of purchased products to EasyPost. We also store the purchased shipping labels on our server to make it easy to reprint them and handle support requests.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
